The agreement between you and YWAIT when you use this website, request a review, register for a webinar, buy the Estate Organizer, or engage us for insurance or estate document coordination. Written to be read, not to be skipped.

Everything on this site is general education. It is not legal, tax or investment advice, and nothing here creates an attorney-client or advisory relationship.

The carrier owns the promise.

Insurance and annuity guarantees come from the issuing carrier and only the issued contract governs — not a brochure, an illustration or a conversation.

Clear terms of sale.

The trust package is $2,495 flat, including the first year of account access with unlimited updates. After year one, account access renews at $29.95 a year. The Estate Organizer is $95 hardcover, shipping included, with 100% credit toward the trust package within 30 days.

Arizona law.

These terms are governed by Arizona law, with venue in Yuma County, Arizona. We ask you to talk to us first, for 30 days, before anyone files anything.

Agreement to these terms

These Terms & Conditions (the “Terms”) are a binding agreement between you and YWAIT. By accessing or using this website, submitting any form, registering for a webinar, requesting a review or consultation, purchasing a product, or engaging us for services, you agree to these Terms. If you do not agree to all of them, please do not use this website or our services.

These Terms apply to every visitor and user of the site. They work together with our Privacy Policy and with the Important Disclosures in the site footer, which are incorporated into these Terms by reference.

Separate written agreements control. If you sign a separate engagement agreement, application, service agreement or carrier contract with us or with an insurance company, and anything in that document conflicts with these Terms, that document controls for the subject it covers.

Who we are

YWAIT Wealth Management, together with YWAIT Consulting, YWAIT Agency and YWAIT Insurance Solutions (collectively “YWAIT,” “we,” “us” or “our”), is an independent insurance and financial services practice based in Yuma, Arizona and owned by Jessica Wade, a licensed life and annuity producer.

Jessica Wade holds a resident insurance licence in Arizona and is licensed in more than 30 additional states. We may transact business only in states where we are properly licensed or exempt from licensure, and not all products are available in all states. Call 619.815.8811 to confirm licensure in your state.

Not legal, tax or investment advice

Everything on this website — articles, guides, webinars, videos, scorecards, organizers, worksheets, calculators and market commentary — is general educational information only. It is not legal, tax, accounting or investment advice, it is not a recommendation to buy, sell or hold any security, and it cannot account for your individual circumstances.

YWAIT is not a law firm and does not practise law. YWAIT is not a registered investment adviser, an investment adviser representative, or a broker-dealer, and is not affiliated with a broker-dealer. We do not manage investment accounts, recommend or sell securities, provide investment advisory services, or charge a fee for financial planning. “YWAIT Wealth Management” is a trade name of this insurance practice and does not indicate registration as an investment adviser.

No attorney-client relationship. Communicating with us, submitting a form, or attending a webinar does not create an attorney-client relationship and is not protected by attorney-client privilege. Such a relationship is formed only with a licensed attorney, in writing.

No advisory or fiduciary relationship is created by this website. Nothing on this site places us in an advisory or fiduciary capacity with respect to your investments.

What this does not disclaim

Nothing in these Terms limits, waives or disclaims any duty we owe you under insurance law. When we recommend an annuity, we are required to act in your best interest under the applicable state best-interest standard, and we do. Nothing here waives any right you have under state insurance law or under any other law that cannot be waived by agreement.

Always consult a licensed attorney and a qualified tax professional in your state before acting on anything you read here. Results discussed or implied on this site are not guaranteed and will vary with your circumstances.

Our services

What we provide is:

  • Education on retirement income, estate planning, probate and insurance.
  • Analysis of the figures you give us — projected retirement income, income gap, what each Social Security or pension election would pay, and how your current documents and beneficiary designations line up with your intent.
  • Life insurance and annuity products we are licensed to offer, placed with third-party carriers.
  • Coordination of attorney-drafted estate documents through a separate professional partnership, plus the funding work — retitling accounts and correcting beneficiary designations.
  • Notary services, offered as a convenience in Arizona and not as a financial or legal credential.

Our deliverable is information and analysis you can act on. The decisions remain yours. All services are subject to availability, to state licensing, and in most cases to a separate written agreement or carrier application. We may decline or discontinue service to anyone, at any time, for any lawful reason.

How we are paid. We are compensated through commissions paid by insurance carriers when you purchase a product, and through flat fees for estate document services and products. We do not charge separately for advice. This creates a material conflict of interest, described in full in the Important Disclosures in the site footer. Ask us how we are paid on any specific recommendation before you act on it.

Eligibility & your information

You must be at least 18 years old and legally able to enter into a contract to use this website or our services. Our services are offered only to persons located in the United States.

You are responsible for the accuracy of what you tell us. Every review, projection, income timeline, worksheet, scorecard and written summary we prepare rests entirely on the information and assumptions you supply. If the inputs are wrong, incomplete or out of date, the output will be too, and we are not responsible for a result that follows from bad inputs. Tell us promptly when your circumstances change.

Do not send Social Security numbers, driver’s licence numbers, or bank or account numbers by ordinary email or text message. Ask us for a secure link instead. See our Privacy Policy for how we handle your information.

Consent to be contacted

Express written consent

By submitting your telephone number through any form on this website, or by giving it to us in person, by phone or at an event, you give YWAIT your prior express written consent to contact you at that number — including a mobile number — by live call, prerecorded or artificial voice message, autodialed call, and text message, for both informational and marketing purposes.

Consent is not a condition of purchase. You do not have to agree to receive calls or texts in order to buy anything from us, receive a quote, or work with us. You may ask for information by calling 619.815.8811 or emailing [email protected] instead.

  • Message frequency varies with your activity — typically no more than a handful of marketing messages a month, plus transactional messages for appointments you booked.
  • Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
  • To stop texts: reply STOP. Reply HELP for help.
  • To stop email: use the unsubscribe link in any message.
  • To stop calls: tell us on any call, or email us, and we will add you to our internal Do Not Call list.

Your mobile number and your text-message consent are never shared with, sold to, or licensed to any third party for their own marketing purposes. Calls may be recorded or monitored for quality and compliance where permitted by law. Full detail is in Sections 6 and 7 of our Privacy Policy.

Electronic records & signatures

By using this website and our services, you consent to receive records, notices, disclosures, agreements and other communications from us electronically — by email, by text, or by posting to this website — rather than on paper, and you agree that an electronic signature has the same legal effect as a handwritten one.

  • What you need. A device with internet access, a current web browser, a working email address, and the ability to open and save PDF files.
  • Paper copies. You may request a paper copy of any record at no charge by emailing us.
  • Withdrawing consent. You may withdraw this consent at any time by emailing us. Withdrawal applies going forward only, and some services cannot be provided without electronic delivery.
  • Keep us current. Tell us promptly if your email address changes.

Insurance carriers and the estate document partnership operate their own electronic delivery and signature systems with their own consents, which you will be asked to accept separately.

Insurance & annuity products

We act as a licensed producer placing products issued by third-party insurance carriers. The carrier, not YWAIT, is the party to your policy or contract. We do not underwrite, approve, issue or pay claims.

  • Only the issued contract governs. No brochure, illustration, webinar, worksheet, email or conversation modifies it. If something we said conflicts with your contract, the contract wins — read it.
  • Guarantees are the carrier’s. Any guarantee depends entirely on the issuing company’s financial strength and claims-paying ability. It is not guaranteed by us, by any bank, or by any government agency. Insurance and annuity products are insurance contracts, not investments, and are not deposits, not FDIC or NCUA insured, and not bank guaranteed.
  • Illustrations are not promises. Non-guaranteed values shown in any illustration are hypothetical, depend on assumptions that will not be exactly realised, and are not a prediction of results.
  • Applications may be declined. No coverage exists until the carrier issues the policy and any required premium is paid. Submitting an application guarantees nothing.
  • Free look. Policies carry a free-look period — typically 10 to 30 days depending on your state and product — during which you may cancel for a refund as provided in the contract. The exact period is stated on your policy.
  • Surrender charges and taxes. Withdrawals may be subject to surrender charges and, before age 59½, to a 10% federal tax penalty in addition to ordinary income tax. Features, riders, crediting rates, caps, participation rates and surrender schedules vary by carrier, state and contract and are subject to change.
  • Replacements. Replacing an existing policy or annuity is not always in your interest and may trigger new surrender charges, a new contestability period and new underwriting. We will tell you when we think a replacement is a bad idea.

Estate document services

YWAIT is not a law firm and does not practise law or provide legal advice. Estate planning documents are attorney-drafted through a separate professional partnership. Our role is education, coordination, and the funding side — retitling accounts and correcting beneficiary designations so the plan actually works.

Fees and what is included

  • The revocable living trust package is a flat fee of $2,495, quoted before you engage us and not billed hourly.
  • The package includes the attorney-drafted trust and its supporting documents, our review and coordination, and the first year of online account access, which covers unlimited updates, changes and restatements to your documents.
  • Annual renewal after year one. Continued account access — including unlimited updates, changes and restatements, the online document vault and 24/7 access — is $29.95 per year after the first year. Renewal is optional. If you do not renew, your executed documents remain yours and remain legally valid; you lose portal access and the no-additional-fee update privilege until you renew, and any amendment or restatement requested while the account is inactive is quoted separately.
  • What “unlimited updates” means: amendments and restatements to the documents in your package, at no additional document fee, while your account access is active. It does not include drafting a different kind of plan, entity formation, litigation, tax return preparation, court filings, or third-party costs such as county recording fees, notary fees outside our own service, or transfer charges imposed by a financial institution. Those are quoted separately if you want them.
  • Fees for other services are quoted in writing before work begins.

Funding is a separate task — and it is the one that matters

An unfunded trust does not avoid probate. We will identify the accounts and property that need to be retitled or redesignated and will help you do it, but completing funding requires action by you and by your financial institutions, and we cannot force a third party to act. We are not responsible for a probate, tax or beneficiary outcome caused by funding steps that were never completed, by assets you did not disclose to us, or by changes you made without telling us.

Cancellation and refunds

You may cancel before drafting begins for a full refund. Once your documents have been drafted, the fee is earned to the extent of the work performed and any third-party drafting cost incurred; we will refund the unearned balance. Once documents have been delivered and executed, the fee is fully earned. Refund requests go to [email protected].

No privilege with YWAIT

Communications with YWAIT are not protected by attorney-client privilege unless and until an attorney-client relationship is separately established with a licensed attorney. If your situation involves contested matters, blended-family conflict, business succession, significant estate tax exposure, special-needs planning or Medicaid planning, we will tell you to retain your own attorney, and you should.

Estate Organizer™ purchases

The YWAIT Estate Planning Organizer™ is sold as a hardcover book at $95, shipping included, and ships directly from YWAIT. A paperback edition is not offered.

  • Payment is due at the time of order and is processed by a third-party payment processor. We do not store your full card number.
  • Shipping is within the United States and is included in the price. Orders typically ship within a few business days; delivery estimates are not guaranteed.
  • Damaged or defective books are replaced at no charge. Tell us within 30 days of delivery and we will send a replacement.
  • Returns. Unused books in resalable condition may be returned within 30 days of delivery for a refund of the purchase price; return shipping is yours unless the book arrived damaged or we sent the wrong item.

The $95 credit

If you purchase the Organizer and then engage us for the $2,495 trust package within 30 days of your Organizer purchase, 100% of the $95 is credited against the trust package fee. The credit applies once per household, is not redeemable for cash, cannot be combined with a refund of the same purchase, and cannot be transferred or applied to insurance premiums or to third-party costs.

The Organizer is an educational and organisational workbook. It is not a legal document, not a will, not a trust, and not a substitute for advice from a licensed attorney or tax professional.

Webinars, events & downloads

Our webinars, seminars, workshops and downloadable resources are general education and are free unless stated otherwise. Attending one does not create a client, advisory or attorney-client relationship.

  • Recording. Sessions may be recorded. By attending you consent to being recorded, including your questions, comments, name as displayed and any video or audio you transmit. If you prefer not to be recorded, keep your camera and microphone off and submit questions in writing.
  • Questions answered live are general. An answer given in a session is based only on what was said in that session and is not individualised advice.
  • Replays are provided as a courtesy and may be edited, delayed or withdrawn.
  • Personal use only. Downloads and replays are licensed to you for personal, non-commercial use. Do not redistribute, resell or present them as your own.
  • Schedules change. We may reschedule or cancel any session.

Where a client comment, review or endorsement appears on this site or in our materials, it reflects that person’s individual experience only, is not a guarantee of similar results, and does not represent all clients. We will disclose whether the person is a client and whether any compensation was provided.

Intellectual property

13.1 Our content. All content on this website — text, graphics, logos, photographs, video, audio, layout, design, worksheets, scorecards, organizers and software — is owned by YWAIT or its licensors and is protected by copyright, trademark and other intellectual property laws. You may view, print and download content for your own personal, non-commercial use. You may not reproduce, republish, distribute, sell, licence, modify, adapt or create derivative works from it without our prior written permission.

13.2 Our marks. The YWAIT name, the YWAIT logo, “It’s Never a Good Time to Plan” and YWAIT Estate Planning Organizer™ are trademarks of YWAIT. Other names and marks appearing on the site are the property of their respective owners, and their appearance does not imply endorsement or affiliation.

13.3 Copyright complaints. If you believe content on this site infringes your copyright, send a written notice identifying the work, the material you say is infringing and where it is located, your contact details, a statement of good-faith belief, and a statement that the notice is accurate, to [email protected] with the subject line Copyright Notice.

13.4 Feedback. If you send us suggestions or ideas about our services, we may use them without obligation or compensation to you.

Acceptable use

When using this website you agree not to:

  • Use the site for any unlawful purpose or in violation of any regulation, or to solicit unlawful activity
  • Submit false, misleading or fraudulent information through any form, or impersonate another person
  • Book appointments you do not intend to keep, or make repeated bookings that disrupt our calendar
  • Attempt to gain unauthorised access to any part of the site, its accounts, servers or infrastructure, or probe or test its security
  • Transmit unsolicited commercial communications, malware, or any code intended to damage or interfere with the site
  • Scrape, crawl, spider or otherwise harvest data from the site by automated means without our written consent
  • Reverse engineer, decompile or attempt to derive the source of any part of the site
  • Use our content or our marks to train a commercial machine learning model, or to create a competing product or service, without our written consent
  • Interfere with or disrupt the integrity, availability or performance of the site

Suspension & termination

We may suspend or terminate your access to this website or to our services at any time, with or without notice, if we believe you have breached these Terms, if we are required to do so by law or by a regulator or carrier, or if we discontinue a service.

You may stop using the site at any time, ask to be removed from our communications, and end any engagement with us as provided in your written agreement. Termination does not affect insurance contracts you hold with a carrier — those are between you and the carrier — and does not affect any fee already earned or any obligation that by its nature survives.

Disclaimers, liability & indemnity

16.1 Disclaimer of warranties. This website and its content are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure, error-free or free of harmful components, or that any content is accurate, complete or current.

16.2 Limitation of liability. To the fullest extent permitted by law, YWAIT and its owners, officers, employees, contractors and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, lost opportunity or loss of goodwill, arising out of or relating to your use of or inability to use this website or our services, whether based in contract, tort, statute or otherwise, even if we have been advised of the possibility.

Our total liability for all claims relating to the website or our services will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred dollars ($100).

What these limits do not cover

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or fraudulent misrepresentation, for death or personal injury caused by negligence, or for any obligation arising under state insurance law. Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you.

16.3 Indemnification. You agree to indemnify, defend and hold harmless YWAIT and its owners, officers, employees, contractors and agents from any claims, liabilities, damages, losses, costs and expenses, including reasonable attorneys’ fees, arising out of or relating to your breach of these Terms, your misuse of the website, your violation of any law, or information you provided to us that was false or misleading.

16.4 Third-party links and platforms. This site links to and relies on third-party sites and services — insurance carriers, calendars, webinar rooms, payment processors and document platforms. We do not control them, are not responsible for their content, availability, security or practices, and their own terms and privacy policies apply. Review them before you provide information.

Governing law & disputes

17.1 Arizona law, Yuma County venue

These Terms and any dispute arising out of or relating to them, to this website, or to our services are governed by the laws of the State of Arizona, without regard to its conflict of law rules. You and YWAIT agree that the exclusive venue for any such dispute is the state or federal courts located in Yuma County, Arizona, and each of us consents to the personal jurisdiction of those courts and waives any objection based on venue or inconvenient forum.

This does not override any right you have under the mandatory consumer-protection or insurance law of your own state, or any dispute procedure required by your insurance contract or by your state insurance department.

17.2 Talk to us first. Before either of us files anything, the party with the complaint will send the other a written description of the dispute and the resolution it wants, to the contact address in Section 20. We each agree to try in good faith to resolve it for 30 days after that notice. Most disputes end here, and this step costs neither of us anything.

17.3 Insurance complaints. Nothing here limits your right to contact your state insurance department, or the insurance carrier directly, about a policy or a producer. Arizona residents may contact the Arizona Department of Insurance and Financial Institutions.

17.4 Time limit. To the extent permitted by law, any claim relating to this website or our services must be brought within one year after it arises, or it is permanently barred.

General provisions

  • Entire agreement. These Terms, the Privacy Policy and the footer Disclosures are the entire agreement between us about this website, and replace any earlier understanding on that subject. Separate signed agreements control their own subject matter.
  • Severability. If any provision is held invalid or unenforceable, it will be modified to the minimum extent needed to make it enforceable, or severed, and the rest stays in full force.
  • No waiver. If we do not enforce a provision, that is not a waiver of it or of any other provision.
  • Assignment. You may not assign these Terms. We may assign them to an affiliate or to a successor in a merger, acquisition or sale of the business.
  • No third-party beneficiaries. These Terms create rights only between you and YWAIT.
  • Force majeure. Neither party is liable for delay or failure caused by events beyond its reasonable control, including outages, carrier or vendor failures, natural events, and acts of government.
  • Survival. Sections 3, 5, 12, 13, 16, 17 and 18 survive any termination.
  • Notices. Notices to you may be sent to the email address you gave us. Notices to us must go to the email and postal address in Section 20.
  • Headings are for convenience only and do not affect interpretation.

Accessibility

We want this site to be usable by everyone, including people who use screen readers, keyboard navigation or magnification. We are working toward conformance with WCAG 2.1 Level AA.

If any part of this site or any of our documents is difficult for you to use, tell us at [email protected] or 619.815.8811 and we will provide the information in an alternative format at no charge and fix the problem where we can.

Changes to these terms

We may modify these Terms at any time. When we do, we will update the Last updated date at the top of this page, and for material changes we will provide additional notice by email, by a notice on this website, or both.

Your continued use of the website or our services after the effective date means you accept the revised Terms. If you do not agree, stop using the site and tell us.
